Why hasn’t Rob Ford sued the Star?

Because truth’s a defence, that’s why.

    If he issued a Statement of Claim, wouldn’t he be subject to a potential Defence motion to attend for hair strand testing?

    Maybe it depends on how long it would take to get any stuff out of his system.

    OR take a drug test OR take a lie detector test. Innocent people would be outraged and would be screaming their innocence from the roof of freaking city hall.

    He doesn’t even have to sue.

    If this is libellous, he needs to issue a defamation notice within 6 weeks of become aware of the alleged defamation. He is not required to do anything after that, but it is a notice to the Star and the world that he genuinely thinks he’s been defamed.

    In fact, since defamation is about reputation, a court will hold it against you if delay in giving a defamation notice. The longer you let a defamation hang out there without challenge, the more likely a court will conclude it wasn’t a big deal and your lawsuit has no merit.

    Why is it that anyone who thinks Ford should sue (re: neo-cons), thinks he should sue the Star? Never do they say he should sue Gawker…..you know, the people who broke the story. What a bunch of whiney, biased babies.

    Simple. Lawsuit would launch a civil trial which requires a lower standard of proof than criminal trial. No doubt papers lawyers, concerned about innuendo, would have ensured enough evidence to win a civil trial. Fords say the papers have billions of dollars (right!) so they “can’t go up against that”. Poor little rich boys. OJ was nailed at the civil trial.
